FNC Ports Rules and Regulations

Print

These FNC Ports Rules and Regulations have been updated and amended. This amended version of the FNC Ports Rules and Regulations will be effective on December 20, 2015, superseding any previous versions and apply to all FNC Ports users.

Effective December 20, 2015

These are the current rules and regulations for FNC's Ports. The FNC Ports include AppraisalPort®, InspectionPort®, TitlePort®, LoanPort and other FNC Ports (sometimes referred to as "Ports"). The FNC Port you use is referred to as "your Port". These rules and regulations govern your account along with the User Agreement for your Port. All previous versions are superseded.

  • Ports Support

    • If you have questions about any of the FNC Ports, you may contact FNC Ports support at 888.963.3330.
    • You may also ask questions by sending an e-mail to fncsupport@corelogic.com.
    • Support is available Monday through Friday from 8:00 a.m. ET to 8:00 p.m. ET.
    • Support is not available on weekends or holidays. A list of the holidays and periods when Support is not available is listed on the various Port websites.
  • Invoices and Payment

    • Invoices are delivered electronically each month on the 1st day of the month. Payment is due by the 15th of each month.
    • FNC does not accept payment by paper check.
    • Payments for all FNC Port amounts can be paid by credit card, debit card, or electronic check to your Port. All of these payment methods are available through the payment process inside your Port. If you need help with any payment options, you should contact FNC Ports Support.
    • Please make your payments on time. Late charges at the rate of 1.5% per month accrue on the amount of any invoice for which payment is not received within thirty days after the date of the invoice. Additionally, an administrative charge of $10.00 shall be imposed for any invoice for which payment is not received within sixty days after the date of the invoice.
    • The FNC Port will impose a fee in the event any payment is returned or refused for any reason based on the amount which FNC is charged by its bank (currently $35.00 but subject to change without notice).
    • It is each FNC Port's policy to suspend access to the FNC Port and the delivery of information to any party who is past due in its obligations to the FNC Port. Currently the FNC Ports suspend service when payments are not received (and the invoice paid) by midnight of the 20th day after the date of the invoice (regardless of whether that date is a business day or not). FNC reserves the right to change that date and time in its sole discretion.
    • If for any reason your Port account has been terminated or charged off or your access to your Port has otherwise been suspended, your Port is not obligated to re-activate your account. If your Port does re-activate your account, it may require you to pay a re-activation fee on your account before granting you access to your Port. The re-activation fee is currently $35.00 (subject to change without notice). In addition, your Port may require that you arrange different payment terms (which may include making advance deposits) before your account is re-activated.
  • Transactions

    • What is a Transaction? Unless otherwise specified for the specific product or service, a transaction occurs and you are obligated to pay an FNC Port fee when you successfully transmit a completed product or service to your Client (the party or parties who engage you in a specific assignment) in response to an Order, whether through one of the FNC Ports, or other method outside of the FNC Ports designated as acceptable by your Client (for example, by email or other delivery). It is considered a completed product or service when your Client “accepts” it as a completed product or service (even if the completed product or service is different from the one originally requested).

It is also a transaction when you perform the service that your Client requested, such as the delivery of a final mortgage Closing Disclosure or the closing of a mortgage loan.
    • By default, the FNC Ports will treat the product or service as accepted after it has been received by your Client but your Client has not taken any action with respect to it within a certain period of time. With respect to services tied to the closing of an underlying transaction such as a mortgage loan or purchase transaction, then the FNC Ports will treat the product or service as accepted upon the closing of that transaction.
    • Multiple communications that are part of the same billable transaction between you and your Client will be considered part of the same Transaction. However, any product or service you deliver which entitles you to a separate fee shall be a separate transaction, and you will be charged a separate FNC Port fee.
    • What is an Order? An Order means an offer or request transmitted through the FNC Ports from one of our Clients for one of your products or services, which in turn you may or may not accept. For example, an Order may be for the performance of an appraisal, for a flood determination, title report, mortgage closing or other settlement service.
  • User Account

    • The FNC Ports use your e-mail as the official means of communication. You should be sure to provide your Port with your most up to date e-mail address and other contact information.
    • You are responsible for all use (including any charges, liabilities or claims which arise) under your Ports user name. You should notify your Port immediately of any unauthorized use of your account of which you become aware.
  • Decorum and Professional Environment

    • The FNC Ports are part of a professional environment in which you and others conduct your activities. To allow you and the others who use your Port to be able to enjoy that professional environment, each FNC Port asks you to promote and respect that professional environment in your use of that FNC Port and your communication with that FNC Port and other users. As a result, the FNC Ports request that you observe the common sense rules listed below. Users who fail to do so, in any FNC Port’s sole discretion, may have their FNC Port account and access to it suspended or terminated.
      • Do not post, communicate or permit any messages that are obscene, vulgar, sexually-oriented, hateful, offensive, threatening, libelous, slanderous or in any manner unlawful.
      • Do not direct a personal insult at or about another user of the FNC Port (whether a “requester” of services or “provider” of services), at the FNC Ports themselves, any FNC personnel or any other person or organization.
      • Do not impersonate or imitate any other person, or misrepresent yourself or your affiliation with any other person or organization.
  • Additional Rights and Responsibilities

    • You may not copy or decompile, disassemble, decrypt or otherwise reverse engineer the FNC Ports or any part thereof.
    • You must protect all confidential information received via any of the FNC Ports using at least the same degree of care you use to protect your own proprietary and confidential information and materials of like importance, but in no event less care than a reasonably prudent business person would take in a like or similar situation.

You should be cautious regarding the use of third party services through which you gain access to your Port, especially where you are required to enter your credentials (username and password or other similar information). The use of such services might compromise the confidentiality of your account or information stored or processed through your account.

FNC reserves the right to block the use of third party services which, in its opinion, may compromise the confidentiality or integrity of any Port or of your account or any other account within any Port.
    • The FNC Ports are neither an agent of the Client (the individual or entity ordering an appraisal, other valuation service or other settlement services), nor an agent of the appraiser, broker, closing agent or other provider (whether an individual or entity) providing any such services. The relationship (including any agreements) between the Client ordering the services and the appraiser, broker, closing agent or other provider providing the services is independent of the FNC Port. Neither the FNC Port nor FNC shall be liable for or obligated by or under any such relationships (or agreements) or any actions of any parties related thereto.

As such, you are responsible for the payment of any fees due to your Port regardless of whether you have received (or expect to receive) payment for your services or not.
    • Your Port can terminate your subscription and access to the FNC Port at any time upon your breach of any provision of the User Agreement or the System Rules (which include these Rules and Regulations for FNC Ports).
    • These rules and regulations govern all FNC Port accounts and may be changed from time to time. Each new version of the rules and regulations will be posted on the various FNC Port websites and will be effective 30 days after it is posted.
